First-Time DUI Penalties in California

First-time DUIs in California are charged as misdemeanors in most circumstances. If driving under the influence resulted in the death or injury of another person, it could be charged as a felony with more severe penalties.

Penalties for misdemeanor DUI convictions in California may include:

  • Fines between $390 to $1000
  • Penalty assessments which are additional charges added to a base fine that may include expenses used to prosecute your case
  • A jail sentence between 48 hours to 6 months (judges will typically order probation rather than jail time for first offenders, however)
  • A six-month license suspension
  • An automatic administrative suspension from the DMV is your blood alcohol concentration (BAC) was above .08% or if you refused a field sobriety test
  • A three to five-year probation that will lead to harsher penalties if you are arrested for another crime
  • Mandatory classes in DUI school

The severity of your charges will depend on your defense strategy and the circumstances of your arrest. If your rights were violated during the time of arrest, such as not being read your Miranda Rights or being subjected to an illegal traffic stop, then it may be possible to have the charges dropped entirely.
